AlgoStyle App Terms of Service

These Terms are the agreement between you and WIF PTE. LTD., trading as AlgoStyle, a Singapore company ("AlgoStyle", "we", "us"), covering your use of the AlgoStyle mobile app.

By tapping "I agree" or using the app, you accept these Terms. If you do not accept them, do not use the app.

Section 14 requires most disputes to go to individual arbitration instead of court, and waives your right to join a class action. You can opt out within 30 days. Please read it.

Shopify merchants using our store app are covered by the separate merchant terms, not these.

1. Who can use AlgoStyle

You must be 18 or older. By using the app you confirm that you are, and that you have not been barred from the service previously.

AlgoStyle currently analyses and recommends womenswear only. Our photo check declines photos it reads as male and offers a waitlist instead. This is a limit of what we have built so far, not a judgment about who you are, and we intend to widen it.

2. What AlgoStyle is — and is not

AlgoStyle uses AI to analyse photos you provide and suggest clothing and outfits.

It is a styling opinion, generated by software. It is not professional advice of any kind, and it is not a measurement service. Specifically:

  • The analysis of your body shape, style identity, and colouring is subjective and frequently imperfect. Reasonable stylists disagree; so do our models.
  • Size recommendations are estimates. Check the retailer's own size guide before buying.
  • Try-on images are AI-generated approximations, not photographs. A garment will not necessarily drape, fit, or look the way the image shows.
  • Nothing in the app is health, medical, fitness, nutritional, or psychological advice. Do not treat body-shape output as a statement about your health or your worth.

We do not sell clothing. Where we link to a retailer, your purchase is with that retailer under their terms, and any problem with the order, the price, the shipping, or the product is between you and them.

3. Your account

Sign-in uses a one-time code sent to your email. Keep access to that email address secure — anyone who can read it can get into your account. Tell us promptly at fit@algostyle.co if you think someone else has access.

One account per person. Do not share it.

4. The photos and content you upload

You keep ownership. Your photos are yours. We claim no ownership of them.

You give us a limited licence. You grant AlgoStyle a non-exclusive, worldwide, royalty-free licence to store, process, analyse, and modify the content you upload solely to provide the app's features to you — running the analysis, generating your try-on images, and building your recommendations.

The licence is limited in exactly these ways:

  • It exists only to serve you. We may not use your photos for marketing, promotion, publication, or any other purpose without asking you separately and getting a yes.
  • It ends when you delete the content or your account, except for copies already made in routine backups, which cycle out.
  • It does not allow us to sell, licence, or transfer your photos to anyone else, other than to the service providers listed in the Privacy Policy who process them on our behalf.

You promise that:

  • The photos are of you, or you have the clear permission of every person shown.
  • No one shown is under 18.
  • The photos contain no nudity, no sexual content, and nothing illegal.
  • You own or are licensed to use anything else you upload.

Uploading a photo of someone else without their permission is a breach of these Terms and may break the law.

5. Your likeness and try-on images

Virtual try-on produces new images built from your photo, keeping your face, hair, pose, and setting.

  • You consent to us generating these images for you when you use the feature. You can stop at any time by not using it, and delete the results.
  • These images are shown only to you. We do not publish them or show them to other users.
  • If you share a try-on image yourself, you are responsible for how it is used, and you should make clear that it is an AI-generated image rather than a real photograph.
  • You may not present a try-on image as a genuine photograph of a product, or use one to mislead anyone.

We may run automated safety checks on generated images and refuse or remove output that appears to violate these Terms.

6. Rules for using the app

Do not:

  • Upload someone else's photo without permission, or any image of a minor.
  • Upload sexual, violent, hateful, or illegal content.
  • Try to make the app generate nude, sexualised, or deceptive images of anyone.
  • Reverse engineer, decompile, scrape, or copy the app or our models, or extract our prompts or outputs to build a competing product.
  • Use bots, scripts, or automated access; overload or probe our systems; or try to reach another user's data.
  • Resell, sublicense, or commercialise the app or its output.

We can suspend or close an account that breaks these rules.

7. Your licence to use the app

We grant you a personal, non-transferable, revocable licence to use the app for your own non-commercial styling. We keep all rights in the app, our models, prompts, designs, and brand.

8. Price

The app is currently free. If we introduce paid features, we will tell you the price before you are charged, and purchases will run through the Apple App Store or Google Play under their billing rules and refund policies.

9. Privacy

How we handle your information is set out in the Privacy Policy, which forms part of these Terms.

10. Ending the agreement

You can stop at any time — delete the app, or email fit@algostyle.co to delete your account and its contents.

We may suspend or close your account if you breach these Terms, if we are required to by law, or if we discontinue the service. Except where you have breached these Terms, we will give you reasonable notice and a chance to retrieve your data.

We may change or discontinue features. If we shut the service down, we will give notice and let you export what is yours.

11. No warranty

The app is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the app will be uninterrupted, error-free, secure, or that its style analysis or recommendations will be accurate or suitable for you.

Some states do not allow certain warranty exclusions, so parts of this may not apply to you.

12. Limitation of liability

To the fullest extent the law allows:

  • We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or lost goodwill.
  • Our total liability to you for all claims is limited to the greater of the amount you paid us in the 12 months before the claim, or USD $100.

These limits do not apply to liability that cannot be excluded by law — including, in many states, fraud, gross negligence, wilful misconduct, or death or personal injury caused by negligence.

13. Indemnity

You will indemnify AlgoStyle against claims arising from your breach of these Terms, your misuse of the app, or content you uploaded that you did not have the right to upload.

14. Disputes — arbitration and class waiver

Talk to us first. Email fit@algostyle.co describing the problem. Most things are fixable, and we ask for 30 days to try before formal proceedings.

Arbitration. If we cannot resolve it, you and AlgoStyle agree that any dispute arising out of these Terms or the app will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will be held in the US county where you live, or by phone or video, or on documents alone — your choice. The arbitrator can award the same individual relief a court could.

Class action waiver. You and AlgoStyle each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Exceptions. Either of us may bring a claim in small claims court, and either of us may seek an injunction in court to stop misuse of intellectual property. Nothing here stops you from reporting a matter to a government agency.

Your right to opt out. You can opt out of this entire section by emailing fit@algostyle.co with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out costs you nothing and does not affect anything else. If you opt out, disputes go to the courts named in section 15.

If it fails. If the class action waiver is held unenforceable as to a particular claim, that claim leaves arbitration and goes to court; the rest of this section still stands.

15. Governing law and venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, and by applicable US federal law. The Federal Arbitration Act governs section 14.

For any dispute not subject to arbitration, you and AlgoStyle agree to the exclusive jurisdiction of the state and federal courts in Delaware — except that you may always bring a claim in your own local small claims court.

Nothing here removes any consumer protection you have under the law of the state you live in.

16. Everything else

  • Whole agreement. These Terms and the Privacy Policy are the entire agreement between us about the app.
  • Severability. If a provision is unenforceable, the rest survives.
  • No waiver. If we do not enforce something immediately, we have not given up the right to.
  • Assignment. You may not assign these Terms. We may, to a successor in a merger or acquisition.
  • Apple and Google. These Terms are between you and AlgoStyle, not the app stores. The stores are not responsible for the app, and they have no obligation to support it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • Changes. We may update these Terms. For material changes we will give notice in the app and ask you to accept before they take effect. Continuing to use the app after a change means you accept it.
